The Academic Edition can only legally be sold to a person with the required
academic credentials, AFAIK. If you've ever purchased from an online
Academic vendor, you know they require documentary evidence before
fulfilling your order.
Before this thread heads down the path of requests for posts of EULA's or
whatever, The *best* place to get a definitive answer is Microsoft.

Actually this one is in the EULA and it says that all owners of the
software must be a educational user and someone posted the portion of
the EULA that stated this fact in the Academic vs. Pro thread.

just be aware that your local laws (which superceed ANY EULA) may provide
"fair use" privilages - so just after you get off the phone from MS have a
dig around for your local consumer laws.
