Yep, we announced on March 29th that we'll be having a Pocket PC Content
Contest. Full details here:

Can contest submissions include EXEs from 3rd party apps such as Flash Assist?

I am interested in submitting to the competition but after reading the terms
and conditions (section 7 and 8) I feel my hard work will exploited.
Does macromedia really expect developers to do there research and development
work for them. I don?t think that the developer should waive there right to
compensation especially if there product is to be used in macromedia
promotions, macromedia wouldn?t. Nor should the developer allow macromedia and
its successors the rite to use steel and exploit the ideas presented in the
entry. All this for a ipod and TV come on.

I would like to see these clauses removed from the terms and conditions before
I will be submitting anything on behalf of my company or my self.

yea, but as long as they keep your logo on the web it doesnt matter, but than
again Im doing it for a hobby so I dont care.

I have a question though, does flash for pocket pc use AS 1.0 ? and also, what
is a reasonable size for your application. Do we submit the .swf and .fla or do
we have to buy sometype of compiler and export it in .exe format?

Hi Spooneyes, How about looking at it from a different perspective?
Currently, as a developer, is very difficult to sell your mobile content
specially Flash Content... I find the exposure you get as a developer a value
that has no price tag. Look at one of the best flash mobile developers:

how cool is that? How would you managed that on your own? I bet from this past
contest, he must be receiving all kinds of job/project offers. I look at it as
a free advertising for my business rather than exploitation.

I have to say, I agree with Spooneyes there. Clause 7 seems pretty standard,
but clause 8 goes way beyond what at first appears like a 'if you win, we'd
like to tell people and show people how you won' clause. This is basically a
blanket coveat allowing unfettered commercial use of your software, almost to
the extent that you had been working for Macromedia during development. It
doesn't actually say that MM is going to *sell* your software, but it doesn't
rule that out, either. I would like to see a clause stating outright that sales
were not a part of the proposal. I do, however, recognize that MM probably
couldn't care less about the few thousand bucks they might make out of a piece
of pocket pc flash software more than they are interested in proclaiming flash
as a real alternative pocket pc development platform. Now, Mocaloca has a
point also, that publicity is an invaluable commodity, which is why I am drawn
to this thread. There are undoubtedly advantages of this competition to both MM
and the winner(s) that far outstrip the fiscal worth of any immediate prizes.
The analogy of inifinitumdesign is not all that accurate,however. That software
(and tidy, it is) is being *advertised* as part of a larger MM 'flash is on
phones' marketing campaign. MM is not (to the best of my knowledge) just giving
the software away for free to all and sundry as this agreement suggests they
might. It's a tricky one. I have a piece that has been in development for
about a year now and is just reaching a very happy version 2.0. Do I submit it
for entry? I think I may wait for how people (including MM..?) react, if at
all...

I agree, there's a problem there. I wanted to submit my application. I'm the
main developer of the commercial title 'PocketWin'. I wanted to submit
PocketWin 2.0 to the contest, but I don't want to submit the full version
intended for sale, and I don't think they'll accept the demo. The idea is
tempting though.
